Terms of Use

These Terms of Use (the “Terms”) are an agreement between you and Andres Canella (“we,” “us,” or “PatYap”) governing your use of the PatYap iPhone application and the patyap.com website (together, the “Service”). By downloading or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

PatYap is an independent app made by an individual developer. It is not affiliated with, endorsed by, or sponsored by Apple Inc. or any language institution.

1. The Service

PatYap is a voice-first language-learning app. You speak out loud in a language you're learning, an AI conversation partner responds, and the app grades your speech and tracks the words you use. The Service is provided for personal, educational, non-commercial use.

PatYap is currently offered as a Public Beta. Features may change, break, or be removed, and the Service may be unavailable at times. We provide it “as is” while we continue to develop it.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms.

3. Your account

To use PatYap you sign in with Apple. You are responsible for keeping your device and Apple ID secure and for activity that happens under your account. Your learning data — the words you've practiced, your conversation history, and your settings — is tied to your account.

4. Acceptable use

You agree not to:

Use the Service for anything unlawful, harmful, or abusive, or to harass or harm others.
Attempt to reverse-engineer, decompile, scrape, or interfere with the Service, its servers, or the AI models behind it, except where such restriction is prohibited by law.
Use the Service to generate content that is illegal, hateful, or infringes someone else's rights.
Resell, sublicense, or commercially exploit the Service or its output without our written permission.

5. AI-generated content

Conversations, corrections, translations, and explanations in PatYap are produced by automated AI systems. They can be inaccurate, incomplete, or inappropriate for a given situation. PatYap is a practice tool, not a certified language course, translator, or professional advisor. Don't rely on it for high-stakes translation or communication without independent verification.

6. Your content

Your voice input and the text of your conversations are “your content.” You keep ownership of your content. You grant us a limited license to process it as needed to run the Service — for example, to transcribe and grade your speech, generate replies, and update your learning progress. How we handle your voice and data is described in our Privacy Policy.

7. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the PatYap app on Apple devices you own or control, in accordance with the Apple App Store Terms of Service and these Terms. We own the app, its design, brand, and content, except for your content and third-party components.

8. Apple App Store

Because you obtain PatYap through the Apple App Store, the Apple Media Services Terms and Conditions also apply, and Apple's standard End User License Agreement (EULA) for licensed applications is incorporated by reference. Where those terms conflict with these Terms, the Apple terms govern for the App Store relationship. Apple is not responsible for the Service and has no obligation to provide support for it.

9. Fees

PatYap is free to use during the Public Beta. If we introduce paid features or subscriptions in the future, pricing and terms will be presented in the app and billed through your Apple account. We'll update these Terms before charging you.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that any language content is accurate.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim (which, during the free Beta, is zero).

12. Termination

You may stop using the Service and delete the app at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service. You can request deletion of your account and data as described in the Privacy Policy.

13. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we'll update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, except where your local consumer-protection law requires otherwise.
